2. Our Products

Tichá linie tvaru offers handmade abstract sculptures intended primarily for interior spaces.

Our sculptures are handmade in Czech using materials including wood, stone and metal.

Because each sculpture is handmade, minor variations in texture, colour, surface, grain, shape or other visual details may occur. Such characteristics are part of the nature of handmade products and do not necessarily constitute a defect.

All sculptures offered through our store are already produced and available for purchase. We do not manufacture sculptures according to individual customer specifications.

3. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colours and other information presented in our online store are accurate.

However, colours displayed on a screen may differ slightly from the actual appearance of a sculpture depending on the customer's device and display settings.

The actual dimensions and characteristics of each product are those stated in the relevant product description.

4. Prices

All product prices are displayed in the currency selected by the customer on the website.

Available currencies may include CZK, EUR and USD.

The applicable product price is the price displayed at the time the order is placed.

Delivery costs are displayed separately during the checkout process unless the order qualifies for free delivery.

We reserve the right to correct obvious pricing or information errors before accepting an order.

5. Placing an Order

To place an order, the customer selects the desired product, adds it to the shopping cart and completes the checkout process.

Before submitting the order, the customer has the opportunity to review and correct the information provided.

By submitting the order, the customer places a binding order to purchase the selected products.

After receiving the order, we will send an order confirmation to the email address provided by the customer.

6. Formation of the Contract

The purchase contract is concluded when we accept the customer's order.

The order confirmation sent by email confirms the details of the purchase.

If a product is unavailable or an obvious error has occurred in the product information or price, we will contact the customer as soon as reasonably possible and may cancel the affected order.

If payment has already been made for a cancelled order, the amount paid will be refunded.

7. Payment

We currently accept the following payment methods:

    Payment card

    Apple Pay

    Google Pay

Payment must be completed during the checkout process unless another payment method is expressly offered.

Payment processing may be carried out by third-party payment providers. We do not store full payment card details on our own systems.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including carrier delays, customs procedures or other unforeseen circumstances.

9. Transfer of Risk

The risk of accidental loss or damage to the goods passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, takes possession of the goods.

This does not affect the consumer's statutory rights concerning defective or damaged goods.

10. Customs and Import Charges

Orders delivered within the European Union are generally not subject to customs duties between EU Member States.

For deliveries to Ukraine, the customer may be required to pay import duties, taxes, customs fees or other charges imposed by the Ukrainian authorities.

Such charges are not included in the product price or standard shipping charge unless expressly stated otherwise.

Any applicable import charges are the responsibility of the recipient.

The customer is responsible for providing accurate information required for customs clearance and for complying with applicable import requirements.

11. Right of Withdrawal

If you are a consumer, you generally have the right to withdraw from a distance purchase contract within 14 days without giving a reason.

For goods, the withdrawal period generally begins on the day following receipt of the goods.

The detailed procedure for exercising this right, including information about returns and refunds, is described in our Return & Refund Policy.

Nothing in these Terms limits mandatory consumer rights provided by applicable law.

12. Complaints and Defective Products

We are responsible for ensuring that the products comply with the applicable legal requirements.

If you receive a defective, damaged or incorrect product, please contact us at:

tichalinietvaru@gmail.com

Please provide your order number and a description of the issue. Photographs may also help us assess the situation more quickly.

Your statutory rights concerning defective goods and complaints remain unaffected by these Terms.

13. Handmade Characteristics

Our sculptures are handmade works of art.

Natural materials such as wood and stone may contain variations, markings, grain patterns, colour differences or other characteristics that make each piece unique.

Small differences between the product photograph and the sculpture received may therefore occur and are not necessarily considered defects.

However, this does not affect your statutory rights if the product is defective or does not conform to the purchase contract.

14. Intellectual Property

All content appearing in the online store, including photographs, product images, text, logos, graphics, designs and other materials, is protected by applicable intellectual property laws unless otherwise stated.

You may not copy, reproduce, distribute, modify or commercially use our content without our prior written permission.

15. Website Use

The customer agrees to use the online store lawfully and not to interfere with its operation or attempt to gain unauthorised access to any part of the website or its systems.

We reserve the right to restrict access to the website where reasonably necessary to protect the store, its systems, customers or other users.

16. Availability of the Website

We make reasonable efforts to keep the online store available and functioning properly.

However, we cannot guarantee uninterrupted or error-free availability at all times.

The website may occasionally be unavailable due to maintenance, technical problems, security measures or circumstances beyond our reasonable control.

17. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

In particular, these Terms do not limit mandatory consumer rights or statutory remedies available to consumers.

18. Applicable Law

These Terms are governed by the laws of the Czech Republic, without prejudice to any mandatory consumer protection provisions that may apply to consumers in their country of residence under applicable law.

19. Consumer Dispute Resolution

If a dispute arises, we encourage the customer to contact us first so that we can attempt to resolve the matter directly.

Consumers may also have statutory rights to use alternative dispute resolution or other consumer dispute mechanisms available under applicable law.

20. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our business, products, services or applicable legal requirements.

The version applicable to an order is the version in force at the time the purchase contract is concluded.
